By accessing or using elmencho.co.ke, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use our website or services.

2. Description of Service

El Mencho Restaurant provides an online platform for ordering authentic Mexican food for delivery or pickup. Services include:

  • Online menu browsing and food ordering
  • Payment processing via M-Pesa, Card, or Cash
  • Customer accounts and order history
  • Loyalty points program and rewards

3. Account Registration

To place orders, you must register an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use
  • Be at least 18 years old or have parental consent

4. Ordering and Payments

a) Placing Orders

By placing an order, you agree to pay the stated price including any delivery fees. All prices are in Kenyan Shillings (KES) and include applicable taxes.

b) Payment Methods

We accept M-Pesa, Credit/Debit Cards, and Cash on Delivery/Pickup. M-Pesa payments are processed securely through Safaricom's API.

c) Order Confirmation

Order confirmation is sent via email and SMS. We reserve the right to cancel any order due to:

  • Item unavailability
  • Payment processing issues
  • Suspected fraud
  • Pricing errors

5. Delivery and Pickup

a) Delivery

Delivery is available within Kajiado Town and surrounding areas. Delivery fee is KES 150. Estimated delivery time is 30-45 minutes but may vary based on traffic and order volume.

b) Pickup

Pickup is free. Your order will be ready in 15-20 minutes. Please bring your order confirmation when picking up.

6. Cancellations and Refunds

a) Customer Cancellation

You may cancel an order within 5 minutes of placing it. Contact us immediately via phone or WhatsApp.

b) Restaurant Cancellation

We reserve the right to cancel orders due to item unavailability. Full refunds will be processed for paid orders.

c) Refund Policy

Refunds are processed within 5-7 business days. M-Pesa refunds will be sent to your original payment number.

7. Loyalty Program

The loyalty program allows you to earn points on orders and redeem them for rewards:

  • Earn 1 point for every KES 10 spent
  • Points are credited after payment confirmation
  • Points expire 12 months after earning
  • Rewards must be used within 30 days of redemption
  • We reserve the right to modify or terminate the loyalty program

8. User Conduct

You agree not to:

  • Use the website for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the website
  • Use bots or automated systems to place orders
  • Harass our staff or delivery personnel
  • Provide false information or impersonate others

9. Intellectual Property

All content on this website including logos, images, text, and software is owned by El Mencho Restaurant or its licensors. You may not reproduce, distribute, or create derivative works without permission.

10. Limitation of Liability

To the maximum extent permitted by law, El Mencho Restaurant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

11. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee that the website will be uninterrupted or error-free.

12. Indemnification

You agree to indemnify and hold harmless El Mencho Restaurant from any claims, damages, or expenses arising from your violation of these terms.

13. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Kajiado County.

14. Changes to Terms

We may update these terms at any time. Continued use of our services constitutes acceptance of the updated terms.
